The Supreme Court ruled that a lower court was wrong to stop Brenda from appealing her conviction. She argues that during her trial, the prosecutors unfairly focused on her personal life, including her sex life and how she was as a mother and wife.
The Supreme Court agreed that the prosecutors spent too much time on this irrelevant information.

At her trial, prosecutors even showed the jury a pair of her thong underwear. Brenda argued that this evidence was unfair and violated her right to a fair trial.
The Supreme Court said that lower courts were wrong to think that using unfair evidence couldn’t violate someone’s rights.
Rob Andrew was shot and killed in his garage in 2001. Brenda was also shot in the arm and called 911, saying they were attacked by two masked men.
After the shooting, Brenda went to Mexico with her boyfriend, James Pavatt, and her children. Later, she and Pavatt were named as suspects.
Prosecutors claimed that Brenda and Pavatt killed Rob to get money from his life insurance. Rob had even told police a month before his death that he suspected Brenda and Pavatt of cutting his car’s brake lines.
Pavatt confessed to a friend that he killed Rob but said Brenda wasn’t involved.
Brenda’s lawyers argued that the case against her was based only on clues, not direct evidence.
Pavatt was convicted of Rob’s murder a year before Brenda and is also on death row.
